Changing Schools in China: Work Permit Transfer Guide for Teachers

Changing schools in China is not simply a matter of signing a new contract. A foreign teacher's legal right to work is connected to the approved employer and position. When the employer changes, the existing Foreigner's Work Permit normally needs to be cancelled and a new application completed for the new school.

This guide explains the practical sequence, the documents teachers should protect, and the questions to settle before leaving a school.

A work permit does not automatically move with you

Beijing's official guidance says a foreign worker changing employers should cancel the current work permit and apply for a new one within three months of cancellation. If the new position is the same as the previously approved one, some work-qualification evidence may not need to be resubmitted; a different position can require a fresh review.

Do not begin teaching for the new school merely because the old permit remains visible or the new contract has been signed. The new employer should confirm the correct local procedure and the date on which legal work can begin.

Documents to obtain before leaving

Ask for these records in writing:

  • Employment separation or work-experience certificate
  • Foreigner's Work Permit cancellation certificate
  • Final payslips and proof of salary payment
  • Tax records or tax-clearance documents when available
  • Social-insurance and housing-fund records where applicable

Official Shenzhen guidance states that the employer completes the cancellation procedure and hands the cancellation certificate to the foreign worker. Local requirements can differ, so both schools should coordinate early.

Work permit and residence permit are different

Cancelling a work permit and changing immigration status are connected but separate processes. Ask the current and future employer:

  1. When will the old work permit be cancelled?
  2. What residence status will cover the transition?
  3. When will the new application be submitted?
  4. May you remain in China during processing?
  5. On what confirmed date may you start work?

Do not rely on informal promises that a school will "transfer the visa later." Request a written timeline and the name of the person handling the application.

Check the new school before resigning

Before giving notice, verify the school's legal name, school-operation licence, approved hiring entity and ability to sponsor the specific teaching role. The organisation named in the contract, salary payment and work-permit application should be consistent or clearly explained.

Avoid these mistakes

  • Starting at the new school before authorization is complete
  • Leaving without the cancellation and separation documents
  • Allowing a recruiter to hold original documents without a receipt

  • Signing a new contract with dates that conflict with the old one

Practical transfer checklist

Before resigning, collect copies of your current permit, residence permit and contract. Ask the new school for a document list and sponsorship timeline. Give notice according to the contract and applicable law. Obtain the separation certificate and permit-cancellation certificate. Keep digital and physical copies, then confirm the new work permit and residence steps before teaching.
